Web Hosting Payment and Cancellation Policy

All fees for web hosting or other services are payable in advance of the service being rendered and shall be in accordance with eBiz Hosting schedule incorporated herein by reference and may be amended from time to time.

In the event that you "the customer" elects to pay with a credit card, the customer authorizes eBizHosting.com, or it's parent company Center Point Media Inc. to charge all fees owed to such credit card at the time they become due based on the billing schedule selected at the time you ordered the services.

Fees for renewal periods after the Initial term shall become due within the 30 day period before the first day of such renewal period. eBiz Hosting. may impose a debt service charge equal to one and one-half percent (1.5%) of the overdue balance or a lesser amount where required by law for each month or portion thereof the overdue amount remains unpaid.

In addition, in the event that any amount due to eBizHosting.com remains unpaid fifteen (15) days after such payment is due, eBizHosting., in its sole discretion, may immediately suspend this Agreement, and/or withhold or suspend Services. The Customer agrees that eBiz Hosting may impose a $20.00 (twenty dollars) fee plus all outstanding fees to reinstate accounts that have been terminated or suspended. All taxes, fees and governmental charges relating to the Services provided hereunder shall be paid by the Customer.

Customer agrees that eBiz Hosting. may charge in advance all fees due for the Services provided to Customer under this agreement to the credit card supplied by Customer during registration or at any time thereafter and the Customer specifically agrees not to charge-back or dispute any payments eBiz Hosting. processes through the Customer's credit card.

eBiz Hosting takes pride in its customer service policies and works with all customers to resolve billing issues.

All eBizHosting.com customers acknowledge and specifically agree that chargebacks - which might occur if a Customer disputes all eBizHosting.com charges directly with Customer's credit card bank - are unlawful if eBizHosting.com the customer has not cancelled their account or the .service has been rendered.

If a customer has a fee dispute with All eBizHosting.com., the customer must contact eBiz Hosting and make every effort to settle their dispute with eBizHosting directly without initiating any chargeback procedures. An attempt to reverse or chargeback a credit card transaction you legitimately owe constitutes non-payment and fraud. Initiating a chargeback without canceling your account, changed your mind, or if we have provide a service constitutes fraud, and immediate legal action may be taken.

In the event that the Customer issues a chargeback or reversal of charges attempting to not pay for hosting or domain services ordered and delivered or for accounts not cancelled, the customer will be responsible for an additional $100.00 billing service fee per occurrence plus any fees incurred by eBiz Hosting which may immediately be turned over to collections including all expenses incurred by them.

Any chargeback will evoke an automatic $100.00 (one-hundred dollars) service fee plus any third partyor bank fees incurred , without exception, for which customer will be held responsible in future collection fees, which may involve third-party collections proceedings.

Please Note: eBizHosting.com is a member of the Credit Bureau and all accounts placed for collection are reported to the credit reporting agencies.

To avoid interruptions in service, accounts are billed on a recurring, subscription basis. Accounts will automatically renew unless explicitly cancelled prior to the renewal date.

All payments are due prior to the beginning of your next billing cycle. Generally your billing period starts on the anniversary date of the day your signed up for our service. eBizHosting.com / Center Point Media Inc. must be notified of all billing errors within 30 days of the invoice being issued. If we are not notified of any mistakes within this time period, we reserve the right to consider the billing correct. All billing issues and disputes For each successive period, your contract is renewed automatically unless we are notified otherwise. Billing period is determined by the billing option you chose at the time of ordering. Your billing period also applies to any additional items and services ordered after the initial activation of you account. Fee for such items and services will be prorated so that the start date matches that of the first domain.

All accounts outstanding for more than 60 days shall be turned over to a third party for collection. A third party collection fee will be added to all accounts.

For payment, we accept Paypal, MasterCard, Visa or American Express, Western Union and Corporate Check.

Cancellation Policy

eBizHosting.com aims to deliver premium web hosting and e-commerce solutions by incorporating the latest in technologically advanced infrastructure, and an experienced and dedicated support staff. Further, in an effort to reduce initiation costs to our customers we have waived setup fees on many of our service plans.

Certain packages will have non-recurring, one-time setup charges, to offset provisioning costs.

In order to cancel your web hosting service we require a minimum of 15 days written notice, You Must use the following method to deliver a notice of cancellation of your account(s):

  1. You must submit your request in writing, by e-mail, using our cancellation form or via facsimile to 1.866.685.2548. All email cancellation requests MUST be submitted from the account's primary email address for authentication purposes. Cancellation requests made by telephone, or by e-mail to any other department, will not be processed.

  2. Log into your Domain Management area of the client area located at https://www.ebizhosting.com/clients/ using your username and password. Locate the hosting account you wish to cancel and Press the Cancel Link. Enter the reason you are cancelling your account and press submit.

Please Note: You are responsible to cancel your account. If you DO NOT cancel your account according to the terms above you will be held responsible for all charges until such date as you cancel your account ..

If eBizHosting.com or the user cancels this Agreement pursuant to any of the terms outlined in this agreement eBizHosting.com / Center Point Media Inc. shall not refund to Customer any fees paid or prepaid in advance of such cancellation and Customer shall be obligated to pay all fees and charges accrued prior to the effectiveness of such cancellation. Prepaid hosting fees are not refundable.

if eBizHosting.com terminates this agreement for cause or due to a customer removing their sites from our servers without proper notice or cancellation of the account.. eBizHosting.com shall also have the right to charge customer a minimum of $75.00 per site Breach-Of-Contract fee.

Under our "30 Day Money Back Guarantee" program, eBizHosting.com will provide customers with a full refund on all hosting services paid, if the customer requests the service cancellation with a valid customer service complaint, within the first thirty (30) days of account activation.

Thereafter, refunds on all accounts (including annual and quarterly packages) will be pro-rated, based on the monthly rate. Any setup fees and/or overage charges assessed, are non-refundable. This guarantee does not apply to accounts that have been closed or suspended due to a violation of this Agreement. Accounts that have been suspended or deactivated as a result of a violation of this Agreement or are cancelled after the first 30 days of service are not eligible for refunds.

EXCLUSIVE REMEDY

YOU AGREE THAT OUR ENTIRE LIABILITY, AND YOUR EXCLUSIVE REMEDY, IN LAW, IN EQUITY, OR OTHERWISE, WITH RESPECT TO ANY SERVICE(S) PROVIDED UNDER THIS AGREEMENT AND/OR FOR ANY BREACH OF THIS AGREEMENT IS SOLELY LIMITED TO THE AMOUNT YOU PAID FOR SUCH SERVICE(S) DURING THE TERM OF THIS AGREEMENT. IN NO EVENT SHALL CENTER POINT MEDIA INC. ITS LICENSORS AND CONTRACTORS (INCLUDING THIRD PARTIES PROVIDING SERVICES AS PART OF THE SUBSCRIPTION SERVICE FOR WEBSITES FROM CENTERPOINT MEDIA ) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES EVEN IF CENTERPOINT MEDIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT THAT A STATE DOES NOT PERMIT THE EXCLUSION OR LIMITATION OF LIABILITY AS SET FORTH HEREIN EBIZ HOSTING'S LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW IN SUCH STATES.
